Install and pay for signals at the intersection <br /> <br />of Valley Avenue and Bernal Avenue prior to construction of <br />buildings on the Fromm property. <br /> <br /> d. Dedicate to the City any of the land owned <br /> <br />by Fromm that is necessary for the above improvements. Fromm <br />agrees to pay the cost of acquiring any additional property <br />required from the County of Alameda or the City of San Francisco <br />for Valley Avenue or the bridge structure in excess of City's <br />obligation as set forth in paragraph 1.2. <br /> <br /> e. A maintenance district or some other privately <br />funded comprehensive procedure shall be used for the maintenance <br />of all interior street surfaces, all public lighting and land- <br />scaping within the development and all required landscape/berm <br />areas. The Valley Avenue and Bernal Avenue medians in front of <br />the Subject Property shall be maintained in the same manner. <br /> <br /> 2.2 Condition Precedent. Fromm shall not be obligated <br />to commence construction of the improvements referred to in <br />paragraph 2.1 until Fromm has received the Notice to be given <br />by the City under paragraph 1.5. <br /> <br /> 2.3 Contribution to Capital Fund. Fromm shall pay <br /> <br />to the City cash in the amount of Two Hundred Thousand Dollars <br />($200,000) as a contribution to the capital fund of the City <br />upon (1) recordation of the first subdivision map (parcel or <br />final) dividing the property described in Exhibit "A", or <br />(2) the date that the capacity described in paragraph 1.1 is <br />constructed and available for use, whichever event occurs earlier. <br /> <br />-6- <br /> <br /> <br />
