300,000 gallons per day of sewer capacity. <br /> <br /> Eo The City has elected to allocate the remainder of <br /> <br />the above-described 500,000 GPD of sewer capacity on the basis <br />of certain criteria contained in a recent policy statement <br />adopted by the City. The Subject Property, the subject of this <br />contract, meets a number of the criteria set forth in the City's <br />policy statement. City has also entered into an agreement with <br />John and Joan Caroline allocating 63,000 GPD of the 500,000 GPD <br />for use on Tract 4326 (Caroline agreement is attached hereto <br />as Exhibit "C"). <br /> <br /> F~ Fromm has indicated a willingness to pay for and <br />install Valley Avenue (between Bernal Avenue and the Arroyo <br />Del Valle), a bridge structure across the Arroyo Del Valle and <br />signals at the intersection of Valley Avenue and Bernal Avenue <br />in addition to any other improvements and dedications required <br />of the PUD or subdivision approvals. <br /> <br /> G. The City desires to obtain the public benefits from <br />Fronnn and in return therefor in order to insure adequate sewer <br />capacity for the proposed business park the City has indicated <br />a willingness to allocate e portion of the 500,000 GPD of sewer <br />capacity described in paragraph D above to the proposed Fromm <br />business park. <br /> <br /> NOW, THEREFORE, the parties agree as follows: <br /> <br /> I. OBLIGATIONS OF CITY <br /> <br /> 1.1 Allocation of Sewer Capacity. City agrees to <br /> <br />allocate 137,000 GPD of sewer capacity to the Fromm business <br />park from that certain 500,000 GPD of "additional sewer capacity" <br /> <br />-2- <br /> <br /> <br />
