CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAmeDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 81-149 <br /> <br />RESOLUTION APPROVING AGREEMENT FOR ALLOCATION <br />OF SEWER CONNECTIONS WITH ALFRED FROMM <br /> <br />WIIEREAS, <br /> <br />the City Council has approved the development plan <br />for approximately 102+ acres located adjacent to Bernal <br />Avenue and 1-680 in tie City of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />the City has entered into an agreement with Willow <br />West Properties for development of 500,000 gallons <br />per day of additional sewer capacity; and <br /> <br />WHEREAS, <br /> <br />Fromm has indicated a willingness to pay for and <br />install certain public improvements including extension <br />of Valley Avenue, a bridge structure across the Arroyo <br />Del Valle and signals at the intersection of Valley <br />Avenue and Bernal Avenue; and <br /> <br />WHEREAS, <br /> <br />the City desires to obtain the public benefits from <br />Fromm and in return therefor, to insure adequate sewer <br />capacity for the proposed business park, the City has <br />indicated a willingness to allocate a portion of the <br />500,000 gallons per day of sewer capacity described <br />above to Fromm. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Approves the Agreement for Allocation of Sewer <br /> Connections with Alfred Fromm, a copy of which is attached <br /> hereto as Exhibit A and by this reference incorporated <br /> herein. <br /> <br />Section 2: Authorizes the appropriate City officials to execute <br /> the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its adoption. <br /> <br />THIS RESOLUTION ADOPTED MAY 12, 1981 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, Kephart, Mohr, Wood and Mayor Mercer <br />NOES: None <br /> <br />By Doris George, Deputy City Clerk~v~~ <br /> ine, City Attorney <br /> <br /> <br />
