Section 1. Recognition Local 1974, International Association of Fire Fighters, ~iFL-CIO-CLC, hereinafter referred to as the "Union," is the formally recognized employee organization for the Fire Employees Unit comprised of the classifications of Firefighter, Fire Lieutenant, and Fire Captain, certified pursuant to the Employer-Employee Relations Procedures & Resolution No. 71-75, adopted by the City of Pleasanton City Council on April 5, 1971. Section 2. Union Security 2.1 Dues Deduction Upon receipt of a written assignment and authorization signed by the employee on the form shown below, the City agrees to deduct from an employee's paycheck an .amount which will total the dues uniformly required for membership in the Union. The amount so deducted-shall be remitted by the City to the officer designated in writing by the President of the Union as the person authorized to receive such funds. ~ne President of the Union' shall notify the City"Ma~ager- in writing as to the amount of such dues uniformly required of all members of the Union. The employee's earnings must be regularly sufficient after other_legal and required deductions are made to cover the amount of the dues checkoff authorized. When an employee iS.in a non-pay status for an entire pay period, no with- holding will be'made to cover that pay period from future earnings. In the case of an employee who is in a non-pay. status during only part of ~he pay peri6d, and the salary is not sn~fficient to cover the full withholding, no deduction shall be made. In this connedtion, ~llother legal and required deduc{ions have priority over union dues. 'In addition, in order to meet certain accounti'ng deadlines, all payroll changes connected with the deduction of said union dues must be made by the fif- teenth (15th) of the preceding month. The Union and the International Association of~Fire Fighters, AFL-CI0-CLC, shall indemnify, defend, and hold the City harmless against-any and all claims, demands, suits, proceedings or court orders~ or any other liability that may arise out of or by reason of action taken or not take~ by the City for the purpose of complying with any of the provisions of this check-off agreement. In addition, the Union shall refund to the City any amounts paid to it in error upon presentation ofsupporting e~idence. The employ~e's authorization request shall be in the following terms: " Date: ..... You are hereby authorized and ~equested to deduct from wages due me such amount as which will total the current amount of my union dues as reported to you by the President of Local'No. 1974, International Association of Fire Fighters, AFL-CIO-CLC and to make such deductions for each and every succeeding ~onth unless and until I revoke this assignment in writing. You ~re hereby authorized and you are to pay the total amount deducted each month to Local No. 1974. This assignment is voluntary'. "Signature
