<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN
<br /> AGREEMENT FOR POST-COLLECTION OF RECYCLABLE MATERIALS
<br /> PROCESSING AND DIVERSION SERVICES BETWEEN THE CITY OF PLEASANTON
<br /> AND GREENWASTE RECOVERY, LLC
<br /> WHEREAS, the Legislature of the State of California, by enactment of the California
<br /> Integrated Waste Management Act of 1989 ("AB 939") and subsequent modifications thereto,
<br /> established a solid waste management process that requires cities and other local jurisdictions
<br /> to implement source reduction, reuse, and recycling as integrated waste management
<br /> practices; and
<br /> WHEREAS, the State of California has found and declared that the amount of refuse
<br /> generated in California, along with diminishing Disposal Site space and potential adverse
<br /> environmental impacts from landfilling, and the need to conserve natural resources, have
<br /> created an urgent need for State and local agencies to enact and implement an aggressive
<br /> integrated waste management program. The State has, through enactment of AB 939 and
<br /> subsequent related legislation, including, but not limited to. the Jobs and Recycling Act of
<br /> 2011 (AB 341), the Event and Venue Recycling Act of 2004 (AB 2176), SB 1016 (Chapter
<br /> 343, Statutes of 2008 [Wiggins, SB 1016), the Mandatory Commercial Organics Recycling
<br /> Act of 2014 (AB 1826), the Short-Lived Climate Pollutants Bill of 2016 (SB 1383), AB 1594,
<br /> AB 1201. AB343. and the Plastic Pollution Prevention and Packaging Producer Responsibility
<br /> Act (SB 54), directed the responsible State agency, and all local agencies, to promote
<br /> Diversion and to maximize the use of feasible waste reduction, reuse, Recycling, and
<br /> Composting options in order to reduce the amount of refuse that must be Disposed; and
<br /> WHEREAS, in 1990, the Alameda County Waste Reduction and Recycling Initiative
<br /> Charter Amendment established a county-wide Solid Waste Diversion rate goal of seventy-
<br /> five percent (75%) by 2010; and
<br /> WHEREAS, in 2010, the Alameda County Source Reduction and Recycling Board
<br /> ("StopWaste") adopted a Strategic Plan that included a new waste diversion goal. By 2020,
<br /> Alameda County wanted less than ten percent (10%) of waste deposited in Alameda
<br /> County's landfills to be readily Recyclable or Compostable; and
<br /> WHEREAS, pursuant to California Public Resources Code Section 40059(a) (2),
<br /> the City has determined that the public health; safety, and well-being require that an
<br /> exclusive right be awarded to a qualified Contractor to provide for the Collection,
<br /> Transportation. and Processing (where permitted under this Agreement) of Solid Waste,
<br /> Recyclable Materials, Organic Materials, Construction and Demolition Debris, Bulky Items
<br /> and other services related to meeting the City's Customer service and
<br /> environmental goals as well as goals established through the City's Climate Action Plan; and
<br /> WHEREAS, the City Council further declares its intent to approve and maintain
<br /> reasonable Rates for the Collection, Recycling, Processing, Composting.. Transfer and/or
<br /> Disposal of Solid Waste. Recyclable Materials. and Organic Materials, and
<br /> WHEREAS, the City Council initiated a request for proposals for Recyclable Materials
<br /> Processing services, and through a competitive procurement process received Contractor's
