MEDEIROS DARREN AND MARYJANE SECOND AMENDMENT

SECOND AMENDMENT TO AGREEMENT (Payment of Fees Required to Remove Heritage Trees) This Second Amendment to Agreement is entered into on March 18, 2025, by the City of Pleasanton ("City") and Darren and Maryjane Medeiros (“Owners”). Whereas, on September 22, 2022, the City and Owners entered into an agreement regarding the payment of fees for the removal of heritage trees; and Whereas, on March 5, 2024, the parties entered into a First Amendment acknowledging the payment of $43,950 in fees by Owners (with $14,000 still outstanding) and that the City would stay the collection of the outstanding amount until such time as the Heritage Tree Ordinance was amended by the City Council; and Whereas, as a result of the ordinance amendments, City has agreed to refund $23,350 of the $43,950 paid by Owners, plus an additional refund of $1,750 as a credit for the trees that Owners have planted on site---for a total refund of $25,100. Now, therefore, the parties agree as follows: 1. Within 30 days of this Second Amendment, City shall issue payment to Owners in the amount of $25,100. Once payment is issued, this matter shall be considered closed.
