RECITALS WHEREAS,the purpose of the City's Art in Public Places program is to promote the acquisition, construction and installment of works of public art that will foster creativity,engender civic pride, encourage a sense of community, and enrich the lives of our citizens(Pleasanton Municipal Code(§ 13.16.020 Art in Public Places. Purpose and Goals.) WHEREAS,the Donor has submitted a proposal to donate to the City the following piece of art ("Artwork")as follows: • Title of Artwork: The Wonderful Wizard of Oz Book Bench • Artist: Kristen Calderon • Medium/Materials: Fiberglass bench • Dimensions: 48" W x 38" H x 38" D • Location: To be installed at an exterior location at the Pleasanton Library WHEREAS, on September 3, 2024,the City Council approved the City's acceptance of donation of the Artwork. NOW THEREFORE,in consideration of the mutual covenants and conditions in this Agreement,City and Donor agree as follows: 1. Donation and Acceptance. The Donor hereby conveys by donation of the Artwork and its legal title to the City, and the City hereby accepts the donation of the Artwork under the terms, qualifications, and conditions as set forth in this Agreement. a. The Donor certifies that the Artwork is a unique work of art created by Kristen Calderon and is not subject to third-party claims of royalties or copyright or trademark infringement. 1
