The City and Developer agree <br />as set forth below. <br />W I T N E S SETH <br />~Jf1EP.EAS, Developer is the o~,mer of real property in the <br />City of Pleasanton described in Exhibit "A", attached to this <br />agreement and made a part of it by reference, whici consists _ <br />genera 11 y Of 1.03 acres located at the south-east intersection of Foothill Rd. <br />and Deodar way (hereinafter referred to as the "project site");and <br />WHEREAS, Developer has received approval for First Interstate <br />Bank, Design Review Subject No. Z-81-121 <br />(hereinafter referred to as subject proj ect) ; and <br />WHEREAS, prior to approving the. project, City.adopted a <br />t4itigated Negative Declaration in which certain measures were <br />_ mutually agreed upon by City and Developer so as to avoid <br />potential significant adverse impacts; and <br />-1- <br />
