REIriBURSEMENT AGREETIENT FOR TRAFFIC STUDY COSTS THIS AGREEMEPdT is made and entered into on this 8th day of December, 1981, by and between VALLEY PLAZA APARTP~Ei1TS (hereinafter referred to as "Developer") and the CITY OF PLEASANTOid, a municipal corporation (hereinafter referred to as "City"). W I T N E S SETH WHEREAS, Developer has applied for development approval for a residential condominium and apartment complex in the City of Pleasanton (PUD-81-23) which consists generally of a 174-unit project located on 9+ acres on Valley Avenue generally known as the Orloff property; and WHEREAS, in response to concerns over possible traffic impacts, a traffic analysis was prepared by TJKM Traffic Engineers and, upon its conclusion and recommendations, the City Staff recommended a Negative Declaration be adopted for the project; and WHEREAS, at the Planning Commission meeting of IJovember 18, 1981, the Planning Commission refused to adopt a Negative Declaration and directed the City Staff to undertake further traffic studies prior to taking action on the project; and WHEREAS, CEQA allows and local City resolution requires the costs of undertaking environmental studies in conjunction with the preparation of Pegative Declarations or EIRs to be borne by the project developer; and -1-
