REIriBURSEMENT AGREETIENT FOR TRAFFIC STUDY COSTS <br />THIS AGREEMEPdT is made and entered into on this 8th <br />day of December, 1981, by and between VALLEY PLAZA APARTP~Ei1TS <br />(hereinafter referred to as "Developer") and the CITY OF PLEASANTOid, <br />a municipal corporation (hereinafter referred to as "City"). <br />W I T N E S SETH <br />WHEREAS, Developer has applied for development approval <br />for a residential condominium and apartment complex in the City <br />of Pleasanton (PUD-81-23) which consists generally of a 174-unit <br />project located on 9+ acres on Valley Avenue generally known as <br />the Orloff property; and <br />WHEREAS, in response to concerns over possible traffic <br />impacts, a traffic analysis was prepared by TJKM Traffic Engineers <br />and, upon its conclusion and recommendations, the City Staff <br />recommended a Negative Declaration be adopted for the project; <br />and <br />WHEREAS, at the Planning Commission meeting of <br />IJovember 18, 1981, the Planning Commission refused to adopt a <br />Negative Declaration and directed the City Staff to undertake <br />further traffic studies prior to taking action on the project; and <br />WHEREAS, CEQA allows and local City resolution requires <br />the costs of undertaking environmental studies in conjunction <br />with the preparation of Pegative Declarations or EIRs to be <br />borne by the project developer; and <br />-1- <br />
