MAINTENANCE AGREEMENT <br />THIS AGREEMENT is entered into this ~~~ day of April, <br />1984, by and between the CITY OF PLEASANTON, a municipal corporation <br />(the "City") and VALLEY BUSINESS ASSOCIATES, a California general <br />partnership ("Valley"). <br />T21: ('TTAT C <br />A. The City and the owners of Valley Business Park ("Park") <br />have created the Lighting and Landscape District No. 1983-1, Valley <br />Business Park, (the "District"), to nay for the costs associated <br />with maintaining certain landscaping, street lighting„ traffic <br />signal and soundwalls, all as set forth in the terms of the <br />District and as generally shown on the schematic plan attached <br />hereto as Exhibit "A" and incorporated herein by this reference. <br />B. The City, pursuant to its obligations under the District, <br />has estimated the cost of maintenance and has assessed the owners <br />of property within the Park those costs (the "Assessment"). For <br />Fiscal Year 1983-84, these costs were estimated at Sixty-Five <br />Thousand Six Hundred Forty-Two and 78/100ths Dollars ($65,642.78). <br />C. The City has collected or will collect the Assessment <br />with the payment of the real property taxes by the property owners <br />in the Park. <br />D. Since the beginning of Fiscal Year 1983-84, Valley has <br />been maintaining and paying for certain street lighting and <br />landscape maintenance in the Park. <br />E. The City and Valley desire to enter into this agreement <br />whereby Valley will be reimbursed for its past expenses and for <br />its continued performance of such acts. <br />-1- <br />
