l <br />PLANNING COr1i~IISSION <br />CITY OF PLF.AS~'~\TO\ <br />COUNTY OF ALAriDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 2258 <br />A RESOLUTION OF THE PLANNING C0`•L~IISSION OF THE CITY <br />OF PLEASANTON APPROVING A CONDITIONAL USE PERriIT FOR <br />JA1'~iES CKOSS AND TEXACO, INC. AS FILED UNDER CASE <br />UP-82-24 <br />WHEREAS, James Cross and Texaco, Inc. have applied for a conditional use <br />permit to operate a service station, not including the sale <br />of gasoline at 44 riission Drive; and <br />[+WEREAS, zoning for the property is C-F (Commercial Freeway) District; and <br />t,THEREAS, at their duly noticed public hearing of January 12, 1983 the <br />Planning Commission considered all public input, relevant <br />documents and the staff recommendations concerning this proposal; and <br />WHEREAS, the Planning Commission found that the proposed location of the <br />conditional use is in accordance with the objectives of the <br />Ordinance Code and the purposes of the district in ~,~hich the <br />site is located; and <br />t,1HEREAS, that the proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be detrimental <br />to the public health, safety, or welfare; or materially injurious <br />to the properties or improvements in the vicinity; and <br />W1iEREAS, that the proposed conditional use will comply with each of the <br />applicable provisions of the Ordinance Code. <br />NOW, THEREFORE, THE PLANNING COi~i~iISSION OF THE CITY OF PLEASP.NTON RESOLVES <br />THE FOLLOWING: <br />Section 1. Approves case UP-82-4, application of James Cross et al for <br />a conditional use permit to operate a service station, not <br />including the sale of gasoline at 44 Mission Drive subject to the <br />conditions attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days following the <br />Planning Commission meeting of January 12, 1983 or on the day <br />following the next meeting of the Council, whichever is later. <br />PASSED AND ADOPTED BY THE PLANNING COMMISSION OF THE CITY OF PLEASANTON ON <br />TIIE 12TH DAY OF FEBRUARY 1983 BY THE FOLLOWING VOTE: <br />AYES: Commissioners Doherty, Getty, Jamieson and Chairperson Lindsey <br />NOES: None <br />ABSENT: Commissioner Wilson <br />ABSTAIN: None <br />DATE: January 12, 1983 <br />
