Box 520 <br />Pleasanton, CA 94566 <br />DECLARATION OF DISCLOSURE CONCERNING EASEMENT <br />THIS DECLARATION OF DISCLOSURE is made this ~_ day of <br />October , 1994 by SIGNATURE PROPERTIES, INC., ("Declarant"). <br />DISCLOSURE <br />1. Declarant is the owner and developer of the Hacienda <br />residential property, which property is described more fully in <br />the attached Exhibit A. <br />2. As part of the development, Declarant is constructing <br />within an easement in favor of the County of Alameda a portion of <br />the linear park, including landscaping and public use trail <br />improvements, for the project. <br />3. This easement extends throughout Alameda and Contra <br />Costa Counties, is often referred to as the "Iron Horse Trail", <br />and is similar to bike paths and walking trails built throughout <br />both Counties which the public uses. <br />4. Alameda County has the authority to use this easement <br />as a Transit Corridor or for other transportation purposes; if <br />the County decided to do so, it could remove the recreational <br />amenities, including the landscaping, which are planned within <br />the easement. <br />5. Declarant believes that for logistical and financial <br />reasons, it is remote that Alameda County will in fact convert <br />this portion of its easement to such use, but the County could do <br />so. <br />6. This Disclosure is intended to, and does, provide <br />notice to persons. who purchase the Exhibit A property of the <br />existence of this easement and its potential conversion to other <br />uses. <br />Ag~roved as to form <br />Michael H.
