CAROLINE, as <br />joint tenants, and KENNETH 0. GOOCH and Jt1DITH GOOCH, as <br />husband and wife, (hereinafter referred to as "Ieveloper"). <br />[~THEREAS, Developer is the owner of a parcel of <br />property fronting on Happy Valley Road, within the City <br />of Pleasanton, more particularly described on Exhibit "A" <br />attached hereto and incorporated herein by .reference; and <br />6VHEREAS, Developer has requested and City has <br />approved a minor subdivision number MS-79-7 subject to <br />numerous. conditions compliance with some of which requires <br />the agreement herein prior to issuance of a building permit; <br />and <br />v1HEREAS, this agreement is intended to comply <br />with conditions of approval numbers 5, 6, 9, and 11 of <br />approval of minor subdivision D?5-79-7. <br />NOW, THEREFORE, IT IS MUTUALLY AGREED BETWEEN <br />THE PARTIES HERETO AS FOLLO'IS <br />1. Developer shall dedicate or cause to be <br />dedicated within fifteen (15) days after having received <br />written notice therefor from the City Engineer of City, <br />to the City of Pleasanton that portion of the property <br />described in Exhibit "A°' hereto determined by the City <br />Engineer to be necessary for the widening of Happy Valley <br />Road. <br />2. That Developer shall construct or finance <br />construction within the right of way described in Para- <br />graph 1 above public improvements to the extent required <br />by the City of Pleasanton. subdivision ordinance including <br />-1- <br />
