Ernest Jones, Jr., son of Ernest Jones, Sr., pointed out the last home on Calico Lane is
a single-story home and the remainder of the homes located on the east side of the project,
looking down onto his father's home, are two-story homes which will impact his father's privacy.
When his father agreed to this project, he was unaware that his easement would be removed
and assumed that traffic would travel down his existing road, which is contrary to what he was
told and contrary to the agreement he signed. He stated that his father did not understand what
he was signing. He believed there was nothing in the agreement that benefited his father's
property. He did not believe the City should be so eager to develop that it stepped on the rights
of a 40-resident who has no intention of developing his four acres. He restated that his father
was not involved in the development of Calico Lane and only sold three acres of property that
was subsequently resold and then later developed.

Mr. Sullivan noted staff has experience in working with applicants and trying to resolve
issues. If there were outstanding issues remaining, he asked why the Jones' family suspended
that process?

Mr. Jones, Jr. said the Jones' family did not suspend the process and the issues were
defined within the agreement, which his father signed. He believed another type of agreement
should be reached, which staff believed was a private issue. He mentioned that his father was
not the sole owner of his property; it is held in a family trust with three trustees, his father being
one of the trustees.

Mr. Sullivan asked if the Jones family would be willing to work with staff and Mr. Jansen
to resolve the issues?

Mr. Jones said yes.

Ernest Jones, Sr., 1725 Rose Avenue, said he has owned this property, and an adjacent
easement for 42 years. He mentioned he met with City staff and signed an agreement that he
believed was only to remove the trees, sprinklers and storm drain and not for the realignment of
the easement.

Mike Green, a Pleasanton resident, was pleased to see many changes in the Downtown
that have been favorable. He believed this project contributed to the same type of other
development in the area; as well as adding needed housing to the Downtown area.

Pat Bitz, a real estate broker in Pleasanton, spoke in support of this project. He
represented the Alteri, Hoiley and Hornbeck families regarding the nine-acre parcel to the west
of the subject site. He mentioned that he had been working with Mr. Jansen for more than ten
years and found him to be a caring, diligent planner who has done a thorough job on this
project. He believed this development would be an asset and enhancement to Pleasanton and
the Rose Avenue area. He supported the removal of the extension of Rose Avenue from the
General Plan.

Mr. Jansen provided rebuttal comments. He mentioned that he had successfully built
developments in the Tri-Valley area such as this project for 20 years. He prided himself on
being honest and diligent which was the case with Mr. Jones. He has documented the
conversations with Mr. Jones pertaining to the agreement, which began prior to 2003 and noted
that every time he met with Mr. Jones, he followed through with written follow up. He presented

Pleasanton City Council
Minutes

11

01/17/06
