Morgan, et al, 1801 Santa Rita Road, fro~ a decision <br />of the Planning Commission approving the aDpliC'ation of Singer Housing <br />Company for Cond'itional Use Permit No. "71-~ Re: Construction and oper- <br />ation of an Arco Service Station on the northwest corner of Hopyard <br />Road and West Las Positas Boulevard, in a Neighborhood Commercial <br />'District <br /> <br />Mayor Reid stated that the public hearing on this matter was closed <br />on June 7, 1971 but he was re-opening this public hearing in order to <br />allow new testimony to betaken. <br /> <br />Mr. Paul McCann, President of Val Vista Homeowners Association asked <br />the City Council to re-evaluate its growth plan rather than adhere to <br />the General Plan. He also asked what criteria the Council used to <br />justify the service station. <br /> <br />Messers. Walter Anderson, Roger Lippon, Roy Scalliotti, John Helm,Ted <br />Archer and Max Muller were among the Val Vista residents who most <br />emphatically stated their objections to the proposed service station. <br /> <br />Councilman Gerton proceeded to explain the past history of the Val <br />Vista Tract and the City's acquisition of industrial land through a <br />compromise with Volk-McLain Development ComDany which included the <br />granting of a commercial site which included a service station. <br /> <br />After a considerable amount of discussion on this issue, it was <br />mowed by Councilman Gerton and seconded by Councilman Spiliotopoulos <br />that the public hearing be closed. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmem~Bera~lis, Gerton, Pearson, Spiliotopoulos and <br />NOES: None Mayor Reid <br />ABSENT: None <br /> <br />Discussion ensued regarding conditions that could be placed on the <br />Conditional Use Permit for the Service Station in order to prevent <br />construction until such time as the Interchange of West Las Positas <br />Boulevard and Interstate Route 680 is completed, which should be <br />from 3-5 years away. <br /> <br />It was moved by Councilman Gerton and seconded by Councilman Beratlis <br />that Resolution No. 71-148, modifying the Conditional Use Permit <br />granted Singer Housing Company by the Planning Commission Resolution <br />No. 1086, by the addition thereto of Condition No. 28 to provide that <br />the service station contemplated herein shall be constructed only <br />concurrently with or following construction of the West Las Positas <br />Boulevard - Route 680 Interchange or overpass, be adopted. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Gerton, Spiliotopoulos and Mayor Reid <br />NOES: Councilman Pearson <br />ABSENT: None <br /> <br /> 2. 7-19-71 <br /> <br /> <br />
