Road and Valley A-~enue. Mr. Edmands stated a Book of Trees Record of donors <br />was being prepared for placement in City Hall. He urged proper care be taken <br />of these trees to insure their longevity for future generations. Mayor Philcox <br />accepted the check and expressed thanks for the donation. Councilmember Le- <br />Claire stated that this was a beautiful legacy of everlasting beauty for the <br />entire City from people who care about the City. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the Chair. <br /> <br />PUBLIC HEARINGS <br />Application of Page Binkley to rezone approximately 2.1 acres on the southeast <br />corner of Black Avenue and Hopyard Road from the RM-4000 (Multiple Residential) <br />District to the PUD (Planned Unit Development) District and for approval of a <br />development plan for a proposed 28.-unit condominium project on the side <br />(Contd, Open from 6-13-77 and 6-27-77) <br /> Mr. Harris briefly reviewed his previous reports dated June 6 and 23, 1977, <br />regarding this matter. <br /> <br /> Mayor Philcox declared the continued public hearing Open. <br /> <br /> No one ~.n the audience spoke in favor of or in opposition to this item. <br /> Mayor Philcox declared the public hearing closed. <br /> <br /> Councilmember Brandes reiterated his opposition to the application for re- <br />zoning because it would allow an increase in density of 20%. He stated he felt <br />this project did not present any unique circumstance or benefit to the City to <br />merit approval of rezoning~ <br /> <br /> ~yor Philcox stated he felt the project would benefit the City by providing <br />more housing at less cost, therefore would not be detrimental. <br /> <br /> Mr. Scheidig explained that this project qualified for sewer allocations <br />from the Morrison Homes judgment. The staff understood that only 23 single <br />family equivalent sewer units were being purchased from Morrison Homes. <br /> <br /> Councilmember Herlihy stated that he had read the Minutes and staff reports <br />related to the past Council action on this project and he felt this was a proper <br />development for the area and since there was a great need for this kind of <br />housing he would support the plan. <br /> <br /> Councilmember LeClaire stated she felt the density would be too high and the <br />integrity of the Zoning Ordinance threatened if the rezoning on the application <br />was approved. <br /> <br /> Councilmember Mercer stated that there was a need for this type of housing, <br />and he felt the developer had met the environmental concerns. <br /> <br /> Councilmember Brandes stated he felt City Council should be consistent in <br />their rezoning deliberations, citing a denial for rezoning on Vineyard Avenue <br />last year. <br /> <br /> 3. 7/11/77 <br /> <br /> <br />
