239 <br /> <br /> Mr. Dean Macari, 455 Sycamore, stated that the 50-foot <br />easement referred to by Mr. Swift is not an easement but his <br />driveway. He indicated that he has a vineyard and a winery and <br />plans to utilize a good portion of his property in the future for <br />this extensive project. He emphasized that he was not interested <br />in having a paved road running through his property. <br /> <br /> Ms. Green stated that the neighborhood was assured at the <br />Planning Commission meeting that the Commissioners would request <br />an agricultural zoning. <br /> <br /> Mr. Mercer indicated that the Planning Commissioners <br />recommended an agricultural zoning, which is also in conformance <br />with the General Plan. <br /> <br /> Mr. Temple inquired if the construction of the new road would <br />mean that certain properties could be subject to condemnation. <br /> <br /> Mr. Swift replied that the City rarely uses condemnation to <br />provide access roads. Property could be subject to ultimate sale <br />if a good number of properties choose to develop, or a road could <br />be created in conjunction with one of the subdivisions to provide <br />the access out to Sycamore Road or the new road. <br /> <br /> Mr. Temple asked if access would continue on Sunol Boulevard <br />should property owners choose not to develop their properties. <br /> <br /> Mr. Mercer replied that Council would decide that. He stated <br />that when Council decides that the Mavridis development should no <br />longer exit on Sunol Boulevard, it would require another access <br />road to those properties. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> It was moved by Mr. Brandes, and seconded by Mr. Butler, that <br />Resolution No. 90-91 be adopted, based on a review of an initial <br />environmental impact study done for this project and on a finding <br />that no significant environmental impact would occur as outlined <br />in the City's guidelines and on a further finding that a negative <br />declaration is appropriate in connection with RZ-90-03, the <br />application of the City of Pleasanton to prezone an approximately <br />2.15 acre site (Gudaitis, 1.58 acres; Thompson, .57 acres) located <br />at 375 and 387 Sycamore Road on the south side of Sycamore Road, <br />approximately 200 feet west of the intersection with Sunol <br />Boulevard to the PUD (Planned Unit Development) - Medium Density <br />Residential District or to any other zoning district consistent <br />with the General Plan. <br /> <br /> - 9 - <br /> 5-15-90 <br /> <br /> <br />
