Mr. Roush indicated that at one time the Developer had <br /> proposed a comprehensive financing plan that would have provided a <br /> bond to cover all the public improvements, including the <br /> reforestation of the common areas. However, that plan has not come <br /> together so the developer is now looking at selling off some of the <br /> lots in order to provide a cash flow. <br /> <br /> Bev Javaheri, 35662 Beeching Lane, Fremont, owner of Lot 7, <br />wished to know if after their home is completed would they not be <br />able to move in until reforestation was done and the reimbursement <br />taken place. <br /> <br /> Mr. Mercer responded that her lot is not affected by the <br />reforestation plan. <br /> <br /> Ms. Pittinger commented that condition 6 should be removed in <br />case priorities change and building permits are issued, because <br />even if the public improvements were made, the reforestation issue <br />would still be hanging over the heads of the owners. <br /> <br /> Rajit Kamlani, 44848 Vista Del Sol, Fremont, also objected to <br />conditions 5 and 6 and stated that owners are incurring a lot of <br />costs each month due to the unresolved issues being discussed and <br />he encouraged the City, the Developer and home owners to work <br />closely together on a regular basis to keep each other informed of <br />the developments. <br /> <br /> Mayor Mercer indicated that Michael Roush would be the City <br />contact for information regarding the status of Golden Eagle Farms. <br /> <br /> Council discussed what means could be used as leverage on the <br />Developer to make sure the public improvements were completed, <br />including filing a claim with the Bankruptcy Court. <br /> <br /> There being no further testimony, Mr. Mercer declared the <br />public hearing closed. <br /> <br /> Mr. Tarvet spoke of his desire to get a complete and total <br />solution to this issue rather than making changes in order to <br />accommodate the developer, who has failed to comply with conditions <br />of approval. <br /> <br /> Mr. Butler says that the reforestation part can be taken out, <br />but you're still not going to be able to get a building permit <br />until the public utilities are in. <br /> <br /> Mr. Tarver moved that the proposed PUD modification be denied <br />until such time that there is a clear understanding of how the <br />project is going to be completed. <br /> <br /> There being no second, Mayor Mercer asked for another motion. <br /> <br />10-15-91 18 <br /> <br /> <br />
