10.08.020 <br />B. It is unlawful for any parent, <br />guardian or responsible adult to know- <br />ingly permit a minor, or by insufficient <br />control, allow the minor to remain in <br />any public place or on the premises of <br />any establishment within the City dur- <br />ing curfew hours. <br />C. It is unlawful for any owner, <br />operator or employee of an establish- <br />ment to knowingly permit a minor to <br />remain in or upon the premises of an <br />establishment within the City during <br />curfew hours. (Ord. 1755 § 2, 1998) <br />10.08.030 Exceptions: <br />A. Minors are exempt from this <br />Chapter when: <br />1. The minor is accompanied by the <br />minor's parent, guardian or responsible <br />adult. <br />2. The minor is on an errand at the <br />direction of the minor's parent, guard- <br />ian or responsible adult, without delay <br />or detour. <br />3. The minor is in a vehicle involved <br />in interstate or intrastate travel. <br />4. The minor is engaged in employ- <br />ment, or going to or returning home <br />from employment, without detour or <br />delay. <br />5. The minor is involved in an emer- <br />gency. <br />6. The minor is on the sidewalk <br />abutting the minor's residence or abut- <br />ting the residence of a next door neigh- <br />bor, and the neighbor has not com- <br />plained to the police about the minor's <br />presence, providing the minor is not <br />otherwise violating the law. <br />7. The minor is attending an official <br />school, religious or other adult-super- <br />vised recreational activity sponsored by <br />the City, a civic organization or other <br />such entity that takes responsibility for <br />the safety of the minor, or when the <br />minor is going to or returning home <br />from such activity, without detour or <br />delay. <br />8. The minor is exercising First <br />Amendment rights protected by the <br />United States Constitution such as the <br />free exercise of religion, freedom of <br />speech or the right of lawful assembly. <br />9. The minor is married or emanci- <br />pated pursuant to law. <br />B. The owner, operator or an em- <br />ployee of an establishment is exempt <br />from prosecution under subsection <br />10.08.020C of this Chapter if he or she <br />notified the police that a minor was <br />present in violation of this Chapter and <br />such minor refused to leave. (Ord. 1755 <br />§ 2, 1998) <br />10.08.040 Inquiry Prior To Citation: <br />Before taking any enforcement action <br />under this Chapter, a police officer <br />shall ask the apparent offender's age <br />and reason for being in a public place <br />or establishment. The officer shall not <br />issue a citation or make an arrest pursu- <br />ant to this Chapter unless the officer <br />reasonably believes that an offense has <br />occurred as provided by this Chapter. <br />(Ord. 1755 § 2, 1998) <br />(Pleasanton 5-99) 246-2 <br />
