He noted that Dennis Beougher, Assi tant City Attorney, is <br />present to answer any questions. <br /> <br />Acknowledging that adult entertainment businesses would be allow in North Pleasanton <br />near the Mall or in the Stanley Business Park, Commissioner Miche otti asked if that indeed <br />would allow Hacienda Business Park to have such a business. Mr. ugher affirmed that <br />Hacienda Business Park could have such a business, but they have dy stated they would <br />not want a business of that nature. Mr. Beougher stated that private action could exclude <br />adult entertainment. <br /> <br />Commissioner Michelotti went on to say that it is personally offensi e to her that an adult <br />entertainment establishment remains a permitted use, while a church or a downtown hospice <br />thrift store needs a conditional use permit. Mr. Beougher explained that fequiring a <br />conditional use permit for adult entertainments or bookstores would ow Council and the <br />Commissioners too much discretion. If elected officials were to res nd to pressure by <br />residents to deny a permit to an owner of such an establishment, the owner could sue the <br />City. <br /> <br />Chairman Hovingh commented that an adult entertainment store in d wntown Pleasanton <br />would probably go broke very quickly anyway. Mr. Beougher no that unfortunately such <br />stores would have to be allowed under the First Amendment. <br /> <br />Commissioner McGuirk asked Mr. Beougher how this ordinance co pares with other cities. <br />Mr. Beougher thought it compared very favorably with other cities. <br /> <br />Planning Commission Minutes May 12, 1993 <br /> <br />Page 14 <br />
