Pleasanton Municipal Code <br />Chapter 18.12, Article I <br /> <br />Chapter 18.12 Administrative Provisions, Article I Generally <br />§ 18.12.040. Public hearing—Time and notice. <br />The zoning administrator shall set the time and place of public hearings required by this title to <br />be held by the city planning commission or the board of adjustment, provided that the <br />commission or the board may change the time or place of a hearing. The city clerk shall set the <br />time and place of public hearings required by this title to be held by the city council, provided <br />that the council may change the time or place of a hearing. Public hearings shall be held not <br />more than 40 days after submission of the applicant or the appeal from a decision unless the <br />applicant or appellant shall consent to an extension of time. Notice of a public hearing shall be <br />given not less than 10 days nor more than 30 days prior to the date of the hearing by publication <br />in a newspaper of general circulation in the city. When the hearing concerns a matter other <br />than an amendment to the text of this chapter or a general plan amendment, notice also shall <br />be given by posting in conspicuous places close to the property affected or by mailing a notice <br />of the time and place of the hearing to the applicant, if any, and to all persons whose names <br />appear on the latest adopted tax roll of the county as owning property in the vicinity of the area <br />that is the subject of the hearing. The zoning administrator shall determine the number and <br />location of posted notices or the area within which property owners are to be notified by mail. <br />Failure to post or mail notices shall not invalidate the proceedings. <br />(Prior code § 2-5.08) <br />A.Public Hearing. When projects under Title 18 of this Municipal Code require a noticed <br />public hearing before a decision on a permit, or for another matter, the public shall be <br />provided notice of the hearing in compliance with Government Code sections 65090 - <br />65096, and Public Resources Code 21000 et seq., and as required by this Chapter. <br />B.Content of notice. Notice of a public hearing shall include all of the following <br />information, as applicable. <br />1. Hearing information. The date, time, and place of the hearing and the name of the <br />review authority; a brief description of the City’s general procedure concerning <br />the conduct of hearings and decisions; and information on where an interested <br />person can obtain additional information. <br />2. Project information. The name of the applicant; the City’s file number assigned to <br />the application; a general explanation of the matter to be considered; and a <br />general description, in text and/or by diagram, of the location of the property that <br />is the subject of the hearing. <br />3. Statement of environmental document or exemption used. If a proposed Negative <br />Declaration, Mitigated Negative Declaration, or final Environmental Impact <br />Report has been prepared for the project in compliance with the California <br />Environmental Quality Act (CEQA) and the City’s CEQA Guidelines, the hearing <br />notice shall include a statement that the review authority will also consider <br />approval of the proposed CEQA determination. <br />C.Method of notice distribution.
