The proposed project's intent is to enhance the safety of the residents on Winding Oaks Drive by limiting access to the street. As conditioned, the gate will allow first responders to access the court in the event of an emergency. In addition, the proposed gate will be required to meet the requirements of applicable City and State codes. As such, the Council concludes that this finding can be made. 7. Whether the proposed development plan conforms to the purposes of the PUD district. The City Council finds the proposed the proposed project is consistent with the intent of PUD-54. Among the purposes of the PUD designation is to permit flexibility in designing a project compatible with the physical features of the property. In addition, the intent is to maintain adequate privacy, and separation between dwellings. The project will not impact the intent of the district. As such, the Council concludes that this finding can be made. SECTION 4. The City Council approves case PUD-54-01M, the application of Linda and Tony Brunetti for PUD Major Modification approval to install a gate at the entrance to Winding Oaks Drive, subject to the conditions as shown in Exhibit A, attached hereto and made part of this ordinance by this reference. SECTION 5. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
