7-08. Damages. The Contractor bears the burden of proving entitlement to and the <br />amount of any claimed damages. The Contractor is not entitled to damages calculated on <br />a total cost basis, but must prove actual damages. The Contractor is not entitled to <br />recovery of any alleged home office overhead. The Eichleay Formula or similar formula <br />may not be used for any recovery under the Contract. The Contractor is not entitled to <br />consequential damages, including home office overhead or any form of overhead not <br />directly incurred at the Worksite; lost profits; loss of productivity; lost opportunity to <br />work on other projects; diminished bonding capacity; increased cost of financing for the <br />Project; extended capital costs; non-availability of labor, material or equipment due to <br />delays; or any other indirect loss arising from the Contract. <br />7-09. Multiple Claims. In the interest of efficiency, City, acting in its sole discretion, <br />may elect to process multiple Claims concurrently, in which case the applicable <br />procedures above will be based on the total amount of such Claims rather than the <br />amount of each individual Claim. Any such election will not operate to change or waive <br />any other requirements of this Section. <br />7-10. Other Disputes. The procedures in this Section 7 will apply to any and all <br />disputes or legal actions, in addition to Claims, arising from or related to this Contract, <br />unless and only to the extent that compliance with a procedural requirement is expressly <br />and specifically waived by City. <br />Valley Avenue Soundwall Repair Project (REBID), CIP No. 18437 <br />Page 47 <br />
