In accordance with Section 4552 of the Government Code, the Bidder shall conform to <br />the following requirements: In submitting a bid to a public purchasing body, the Bidder <br />offers and agrees that if the bid is accepted, it will assign to the purchasing body all <br />rights, title and interest in and to all causes of action it may have under Section 4 of the <br />Clayton Act (15 U.S.C. Sec. 15) or under the Cartwright Act [Chapter 2 (commencing <br />with Section 16700) of Part 2 of Division 7 of the Business and Professions Code], <br />arising from purchase of goods, materials, or services by the bidder for sale to the <br />purchasing body pursuant to the bid. Such assignment shall be made and become <br />effective at the time the purchasing body tenders final payment to the Bidder. <br />SECTION 4. LEGAL RELATIONS AND RESPONSIBILITY <br />4-01. Travel and Subsistence Pam: <br />(a) As required by Section 1773.1 of the California Labor Code the <br />Contractor shall pay travel and subsistence payments to each worker <br />needed to execute the Work, as such travel and subsistence payments <br />are defined in the applicable collective bargaining agreements filed in <br />accordance with this Section. <br />(b) To establish such travel and subsistence payments, the representative <br />of any craft, classification, or type of worker needed to execute the <br />contracts shall file with the Department of Industrial Relations fully <br />executed copies of collective bargaining agreements for the particular <br />craft, classification or type of work involved. Such agreements shall <br />be filed within 10 days after their execution and thereafter shall <br />establish such travel and subsistence payments whenever filed 30 days <br />prior to the call for bids. <br />4-02. State Wage Determination: <br />(a) As required by Sections 1770 et seq., of the California Labor Code, the <br />Contractor shall pay not less than the prevailing rate of per diem wages <br />as determined by the Director of the California Department of <br />Industrial Relations. Copies of such prevailing rate of per diem wages <br />are on file at the City's Engineering Counter, which copies shall be <br />made available to any interested party on request. The Contractor shall <br />post a copy of such determination at each job site. <br />(b) As provided in Section 1775 of the California Labor Code, the <br />Contractor shall, as a penalty to the City, forfeit $50.00 for each <br />calendar day, or portion thereof, for each worker paid less than the <br />prevailing rates as determined by the City Engineer for such work or <br />craft in which such worker is employed for any public work done <br />under the contract by it or by any subcontractor under it. <br />Valley Avenue Soundwall Repair Project (REBID), CIP No. 18437 <br />Page 35 <br />
