already dangerous, as well as of possible fill materials included. Cleanup measures have
been performed but that does not satisfy someone who still understands that hazardous
materials levels are close to certain dangerous hazardous levels and could be al ready
there in other areas, given the threat of earthquakes and other ground movement due
to the nature of the soil composition, dangerous levels could very well move or be
displaces by events to come. As previously noted in a letter dated June 22, 2023 an d
referred to in Draft EIR page 3.8.2, there is a warning sign concerning hazardous
materials on the NW corner of the proposed Phase 2 site. This is not satisfactorily
addressed in the Draft EIR.

3) We are uncertain of the stability and true testing of the fill materials and its ability to
withstand physical and liquefication stresses as may be caused by earthquakes and
extreme rain conditions and the like, as caused mud and water invasive damage to
many homes to the immediate west of the Phase 1 site. The construction of the
proposed retaining wall is not defined in the EIR and past performance of grading does
not instill confidence in future design performance to keep present homes of the
residents west of the proposed Arroyo Lago protected from mudslides and slush spill
out onto our properties, causing dangerous and hazardous conditions.

Page 3700 App F of the Draft EIR showing one previous plan for development, starting with
Phase 1 (Arroyo Lago) including multiple access roads, not only Busch Rd, but also El Charro.
Another drawing, their Fig. 7, shows a plan in more detail, also includ ing the AOC 6 Busch PIT.
P 6262 Appendix.
