<br />DRAFT 2025 Legislative Positions <br /> <br />3 | P a g e <br />Updated 4.21.2025 <br />4 AB 712 (Wicks) <br /> <br />Housing reform <br />laws: enforcement <br />actions: fines and <br />penalties <br />This bill, where the applicant for a housing development is a <br />prevailing party in an action brought by the applicant to <br />enforce a housing reform law against a public agency, would <br />entitle an applicant for a housing development project to <br />reasonable attorney’s fees and costs and would require a <br />court to impose fines on a local agency. The bill would prohibit <br />a public agency from requiring the applicant to indemnify, <br />defend, or hold harmless the public agency in any action <br />alleging the public agency violated the applicant’s rights or <br />deprived the applicant of the benefits or protection provide by <br />a housing reform law. <br />Oppose None/Oppose <br />Unless Amended <br /> <br />CalCities is <br />requesting <br />amendments to <br />require specific list <br />of violations that <br />would qualify for <br />fines, opportunity <br />for court <br />supervised <br />correction, and <br />clarification on <br />indemnification <br />provisions <br />5 SB 79 (Wiener) <br /> <br />Housing <br />development: <br />transit-oriented <br />development <br />This bill authorizes a residential development within a ¼ or ½ <br />distance of transit stops in a residential, mixed -use, <br />commercial, and light industrial zone, to be developed with <br />maximum height, minimum density and FAR, and additional <br />development benefits, based on the type of transit service <br />provided.
