2 <br /> <br />c. All proceeds earned by the Pleasanton Lions Club, minus the actual costs of <br />purchasing the plaques, shall be donated to: <br /> <br />City at: Finance Department <br />123 Main Street (in person) or PO Box 520 (by mail) <br />Pleasanton, CA 94566 <br />Attn: Sponsorship Donation <br /> <br />d. Donor shall provide to City the proposed text to be engraved on all plaques to ensure <br />said plaques do not contain unprotected speech. <br /> <br />3. City Duties. <br />a. The City shall be responsible for all labor and materials costs for installing the plaques. <br />b. The City shall have sole discretion to determine the installation schedule of the plaques , but shall <br />make all reasonable and best efforts to install the plaques in a timely manner. <br /> <br />c. The City shall conduct maintenance on the plaques only in the case of vandalism and will <br />be funded through the City’s General Fund for Maintenance and Conservation. <br /> <br />d. The City shall apply the donated proceeds to offset the construction costs of the <br />Bandstand. <br /> <br />e. The City reserves the right to reject any plaques containing unprotected speech. No <br />plaque shall be rejected for containing protected speech. <br /> <br />Relocation or Replacement. The City retains the right to relocate the plaques from public <br />display for any reason, at the sole discretion of and cost to the City, including, but not limited to, <br />hazards to public health, safety, or welfare; unsightly or deteriorated conditions of the plaques; or <br />the need to access, repair and maintain public facilities. At the City’s sole discretion, should the <br />condition of the original plaques deteriorate to such extent that it becomes infeasible to maintain <br />the original plaques at reasonable cost to the City, the City shall provide Donor with the <br />opportunity to furnish to the City replacement plaques. <br /> <br />4. Notice. All notices herein required shall be in writing, by certified mail, return receipt <br />requested, and shall be served on the parties as listed below.
