RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL PLEASANTON APPROVING THE 2025 WEED AND AUTHORIZING THE ABATEMENT OF WEEDS, UPON OR IN FRONT OF CERTAIN DESCRIBED CITY OF PLEASANTON Attachment 1 REVISED OF THE CITY OF ABATEMENT PROGRAM DIRT, RUBBISH OR REFUSE PROPERTIES WITHIN THE WHEREAS, at its meeting of March 4, 2025, Council adopted Resolution No. 2025-010 declaring as a public nuisance all weeds, dirt, rubbish or refuse upon or in front of certain described properties within the City of Pleasanton as more particularly set forth in Exhibit "A", attached hereto; and WHEREAS, Resolution No. 2025-010 was adopted pursuant to the provisions of Government Code Sections 39560-39588; and WHEREAS, Resolution No. 2025-010 designated April 15, 2025, at the hour of 7:00 p.m., as the time, date and place to hear and consider objections to the abatement and removal of weeds, rubbish or refuse upon or in front of certain described properties within the City of Pleasanton; and WHEREAS, the Livermore -Pleasanton Fire Department (LPFD) was charged with performing the duties imposed by Government Code Sections 39560-39588, and LPFD did prepare notices to destroy weeds and remove rubbish and refuse; and WHEREAS, in accordance with Government Code Section 39567.1, LPFD mailed to all persons owning property described in Exhibit A or post on the property, written notice of the proposed abatement and the public hearing; and WHEREAS, the City Council did hold a public hearing on April 15, 2025 and no objections were presented; and WHEREAS, abatement of the nuisance may be performed by the City or by a contractor; and WHEREAS, before the weeds are abated by the City or a contractor, any property owner may remove the weeds, rubbish, or refuse at the property owner's own expense. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The City, or a contractor awarded the work by the City, is ordered to abate the nuisance declared by Resolution No. 2025-010 by causing the weeds, dirt, rubbish and refuse to be removed. The City, contractor, Livermore -Pleasanton Fire Department (LPFD) Fire Inspector, and Fire Inspector's designee may enter upon private property to abate the nuisance. Before the weeds are abated by the City or contractor, any property owner may remove the weeds, rubbish, or refuse at the property owner's own expense. SECTION 2. LPFD shall keep an account of the abatement cost for each parcel on which work is done and shall submit to the City Council for consideration, hearing objections, modification, and confirmation, an itemized written report showing the cost pursuant to Government Code Section 39574.
