<br />April 1, 2025 1 City of Pleasanton/GreenWaste Recovery, LLC <br />AGREEMENT 1 <br />BETWEEN 2 <br />THE CITY OF PLEASANTON 3 <br />AND 4 <br />GREENWASTE RECOVERY, LLC 5 <br />FOR 6 <br />RECYCLABLE MATERIALS PROCESSING, AND DIVERSION 7 <br />SERVICES 8 <br /> 9 <br />This Agreement for Recyclable Materials Processing and Diversion Services (“Agreement”) is entered into on the ___ 10 <br />Day of ___________, 2025, by and between the City of Pleasanton (hereinafter, “the City”), and GreenWaste 11 <br />Recovery, LLC (hereinafter, “Contractor”) (collectively, the “Parties”). 12 <br />RECITALS 13 <br /> WHEREAS, the Legislature of the State of California, by enactment of the California Integrated Waste 14 <br />Management Act of 1989 (“AB 939”) and subsequent modifications thereto, established a solid waste management 15 <br />process that requires cities and other local jurisdictions to implement source reduction, reuse, and recycling as 16 <br />integrated waste management practices; 17 <br /> WHEREAS, the State of California has found and declared that the amount of refuse generated in California, 18 <br />along with diminishing Disposal Site space and potential adverse environmental impacts from landfilling, and the 19 <br />need to conserve natural resources, have created an urgent need for State and local agencies to enact and 20 <br />implement an aggressive integrated waste management program. The State has, through enactment of AB 939 and 21 <br />subsequent related legislation, including, but not limited to, the Jobs and Recycling Act of 2011 (AB 341), the Event 22 <br />and Venue Recycling Act of 2004 (AB 2176), SB 1016 (Chapter 343, Statutes of 2008 [Wiggins, SB 1016), the 23 <br />Mandatory Commercial Organics Recycling Act of 2014 (AB 1826), the Short-Lived Climate Pollutants Bill of 2016 (SB 24 <br />1383), AB 1594, AB 1201, AB343, and the Plastic Pollution Prevention and Packaging Producer Responsibility Act (SB 25 <br />54), directed the responsible State agency, and all local agencies, to promote Diversion and to maximize the use of 26 <br />feasible waste reduction, reuse, Recycling, and Composting options in order to reduce the amount of refuse that 27 <br />must be Disposed; 28 <br /> WHEREAS, in 1990, the Alameda County Waste Reduction and Recycling Initiative Charter Amendment 29 <br />established a county-wide Solid Waste Diversion rate goal of seventy-five percent (75%) by 2010; 30 <br /> WHEREAS, in 2010, the Alameda County Source Reduction and Recycling Board (“StopWaste”) adopted a 31 <br />Strategic Plan that included a new waste diversion goal. By 2020, Alameda County wanted less than ten percent 32 <br />(10%) of waste deposited in Alameda County’s landfills to be readily Recyclable or Compostable; 33 <br /> WHEREAS, pursuant to California Public Resources Code Section 40059(a)(2), the City has determined that 34 <br />public health, safety, and well-being requires that an exclusive right be awarded to a qualified Contractor to provide 35 <br />for the Collection, Transportation, and Processing (where permitted under this Agreement) of Solid Waste, 36 <br />Recyclable Materials, Organic Materials, Construction and Demolition Debris, Bulky Items and other services related 37 <br />to meeting the City’s customer service and environmental goals, as well as goals established through the City’s 38 <br />Climate Action Plan; 39
