<br /> 1 <br />RIGHT OF ENTRY FOR CONSTRUCTION <br />& <br />TEMPORARY CONSTRUCTION EASEMENT <br />(3901 Foothill Road, Pleasanton, CA) <br /> <br /> This Right of Entry for Construction (the “Agreement”) is entered into this <br />____________, 2025, between the City of Pleasanton ("City") and Rennie & Diane <br />Bowers (the “Owner"), the owner of real property described in this Agreement. <br /> <br />RECITALS <br /> <br /> WHEREAS, City is planning storm drain improvements at the Puri Court (the <br />“project”), which is adjacent to Owner’s real property commonly known as 3901 Foothill <br />Road (the “Property”, APN (941-2766-41); and <br /> <br />WHEREAS, City’s improvements to the Puri Court includes replacing existing <br />storm drain with 48 inches reinforced concrete pipe storm drain and variable sized box <br />culvert, storm drain manhole replacements, headwall replacement, sewer lateral <br />replacement, minor concrete work including curb and gutter, valley gutter, and driveway, <br />landscaping modification and surface restoration; and <br /> <br />WHEREAS, City will also make improvements to Owner’s Property as described <br />in this Agreement; and <br /> <br /> WHEREAS, Owner is willing to allow City to enter onto portions of the Property to <br />make improvements for the project, as well as make improvements to Owner’s <br />Property, subject to the terms of this Agreement. <br /> <br /> NOW, THEREFORE, in consideration of the mutual promises contained in this <br />Agreement, the parties agree as follows: <br /> <br />1. Improvements to Owner’s Property. Without cost to Owner, the City, its <br />employees and contractors will make the following improvements to Owner ’s Property <br />as follows: <br /> <br />a. Clear and grub portion of the front yard to allow for six (6) temporary parking <br />stalls and staging area; <br />b. Remove and replace sidewalk, curb and gutter necessary for stabilized <br />entrance and exit to utilize temporary parking stalls and staging area; <br />c. Make landscaping modification as per landscaping, planting and irrigation <br />plan; <br />d. Remove and replace sewer lateral and connect to city sewer main; <br />e. Replace any damaged plantings and irrigation restoring to existing or <br />improved condition within the temporary construction easement area; <br />f.
