ATTACHMENT 1 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING ORDINANCE NO. 1428 TO UPDATE PLEASANTON MUNICIPAL CODE CHAPTER 13.08 TO ADDRESS UNAUTHORIZED USES OF PARK AND RECREATION FACILITIES WHEREAS, on August 15, 1989, the City Council adopted Ordinance No. 1428 repealing then existing Chapter 13.08, “Recreation Facilities” and adopting a revised Chapter 13.08, to be entitled “Parks and Recreation Facilities; and WHEREAS, on August 18, 2015, the City Council adopted Ordinance No. 2125, which amended Chapter 13.08 of the Municipal Code to ban smoking in City parks, trails and adjacent parking lots; and WHEREAS, there has been a rise in the amount of unauthorized field use by “travel” teams, private athletic trainings, and various sports clinics; and WHEREAS, there is a need to define “organized activity”; and WHEREAS, there is a need to clarify that organized activities require an approved use permit; and WHEREAS, there is a need to include the director’s designee as an additional person able to issue permits; and WHEREAS, there is a need to include select neighborhood parks to be used with an approved use permit; and WHEREAS, the Park and Recreation Commission at its November 14, 2024 meeting recommended that the City Council adopt staff’s recommendation to approve an ordinance amending various portions of Chapter 13.08 of the Municipal Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Amendment. Ordinance No. 1428 is amended to update Chapter 13.08 of the City of Pleasanton’s Municipal Code, the specifics of which are included in Exhibit A, to address the unauthorized use of City park and recreation facilities. SECTION 2. Severability. If any part of this ordinance is declared invalid by a court, such invalidity shall not affect any of the remaining parts. SECTION 3. Publication. This ordinance, or a summary of this ordinance, shall be published once within fifteen (15) days after its adoption in “The Valley Times,” a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk’s office within fifteen (15) days after its adoption. SECTION 4. Effective Date. This ordinance shall be effective thirty (30) days after its passage and adoption.
