Page 2 of 3 <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. This Resolution of Summary Vacation for Public Service and <br />Access Easements and Acceptance of Replacement Public Service and Emergency <br />Vehicle Access Easements at 29 Grey Eagle Court is hereby adopted based on the <br />following: <br />•The summary vacation of Public Service and Access Easements is made <br />under California Streets and Highways Code §8330 et seq. <br />•The Public Service and Public Access Easements to be summarily <br />vacated were granted across Parcels 10 and 11 of Tract 5189 “Grey Eagle <br />Estates” recorded in Book 148 of maps at pages 46 to 51 on October 23, <br />1984 (currently 29 Grey Eagle Court) as accepted by the City Clerk and as <br />described in detail in the Quitclaim of Easement and Grant of Public <br />Service and Emergency Vehicle Access Easements to be recorded <br />together with this Resolution. <br />•This Resolution is prima facie evidence that the Public Service and <br />Access Easements are superseded by relocation or determined to be <br />excess. <br />•That from and after the date this Resolution is recorded, the vacated <br />Public Service and Access Easements no longer constitute a street, <br />highway, or public service easement. <br />•That all entities having any right, title, or interest in the Public Service <br />Easement being vacated have been notified of this action. <br />SECTION 2. The City Manager shall execute the Quitclaim of Easement and <br />Grant of Public Service and Emergency Vehicle Access Easements as authorized by <br />City Council Resolution No. 89-31. <br />SECTION 3. The City Clerk shall cause a certified copy of this Resolution, as <br />attested under seal, to be recorded without acknowledgment, certificate of <br />acknowledgment, or further proof in the office of the Alameda County Recorder together <br />with the fully executed Quitclaim of Easement and Grant of Public Service and <br />Emergency Vehicle Access Easements. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of <br />Pleasanton at a regular meeting held on January 16, 2024. <br />I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the <br />foregoing resolution was adopted by the City Council at a regular meeting held on the <br />16th day of January 2024 by the following vote: <br />Ayes: <br />Noes: <br />Page 127 of 201
