4
THE CITY OF
iftlik'' CITY COUNCIL AGENDA REPORT
PLEASANTON,
September 19, 2023
Community Development
TITLE: APPROVE A SECOND AMENDMENT TO THE PROFESSIONAL SERVICES
AGREEMENT WITH FIRST CARBON SOLUTIONS, EXTENDING THE TERM
AND AUGMENTING THE SCOPE AND COMPENSATION BY $84,578 FOR
ADDITIONAL REQUIRED ENVIRONMENTAL REVIEW, FOR A REVISED
NOT-TO-EXCEED TOTAL CONTRACT AMOUNT OF $346,594 AND
APPROVE A NEW REIMBURSEMENT AGREEMENT WITH PONDEROSA
FOR THESE SERVICES IN A COMMENSURATE AMOUNT, RELATED TO
THE PROPOSAL OF 30 SINGLE-FAMILY DETACHED HOMES,
ASSOCIATED IMPROVEMENTS, AND LAND DEDICATION ON THE
LESTER AND PONDEROSA PROPERTIES
SUMMARY
Staff requests approval of an amendment to the Professional Services Agreement (PSA)
with First Carbon Solutions (FCS), the firm preparing the EIR for Ponderosa's
development applications. In addition, staff requests approval of a new, related
reimbursement agreement with Ponderosa Homes to reimburse the City for the cost of
the EIR work. The PSA and initial reimbursement agreement were approved by the City
Council in September 2018; however, environmental work did not begin until 2019, after
new California Environmental Quality Act (CEQA) guidelines took effect. The PSA
needed to be amended to address and analyze the added environmental topics. The first
amendment to the PSA was approved by the City Council in September 2019, and
although FCS began work on the EIR the development applications were put on hold in
2020 due to the pandemic and later due to the four subject properties being included in
the City's Housing Element Update (HEU). With the HEU complete, City and FCS staff
can reinitiate work on the project. If approved, the proposed second amendment to the
PSA would bring the contract total to a not-to-exceed amount of $346,594, which
includes the previously established 15 percent contingency on the original contract
amount (contingency amount of$28,976).
RECOMMENDATION
1. Authorize the City Manager to execute a second amendment to the PSA with FCS,
updating the scope of work, extending the term, and adding compensation in the
amount of $84,578, for a revised total not-to-exceed contract amount of $346,594
(including the $28,976 contingency) for continued services related to the EIR
preparation (Attachment 1), subject to minor modifications approved by the City
Manager and City Attorney.
2. Authorize the City Manager to execute a new Reimbursement Agreement with
Ponderosa Homes for reimbursement of all costs associated with the PSA with FCS,
