Box 520 <br />Pleasanton, CA 94566 <br />GRANT OF EASEMENT <br />Recording requested Pursuant to <br />Government Code Sections <br />No Fee - 27383 & 6103 <br />APN: 941-1311-019-05 <br />THIS GRANT OF EASEMENT is made and entered into this day of . 2022 by and <br />between Costco Wholesale Corporation, a Washington Corporation ("Grantor') and the City of Pleasanton <br />("Grantee"). <br />For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee permanent <br />easements and right of way for roadway, sidewalk and landscaping purposes, including the right to <br />construct, replace, inspect, maintain, repair, operate or remove a roadway, supporting columns, walls and <br />footings, sidewalks, pathways, landscaping including any and all appurtenances thereto, over, under, upon <br />and across the following described real property situated in the City of Pleasanton, County of Alameda, <br />State of California, described as follows: <br />Exhibits 'A" "B," "C," and "D" attached hereto and made a part hereof. <br />The Grantor reserves the right to use the easement parcels for all purposes not inconsistent with the <br />easements. However, such use by the Grantor shall not include the construction of permanent structures, <br />including but not limited to buildings, retaining walls, decks, patios, or other concrete structures within the <br />easements. <br />Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the <br />surface of the ground to the condition in which it was prior to the commencement of said construction. <br />This instrument shall run with the land and inure to the benefit of the successors and assigns of the parties <br />hereto. <br />
