Box 520 Pleasanton, CA 94566 GRANT OF EASEMENT Recording requested Pursuant to Government Code Sections No Fee - 27383 & 6103 APN: 941-1311-019-05 THIS GRANT OF EASEMENT is made and entered into this day of . 2022 by and between Costco Wholesale Corporation, a Washington Corporation ("Grantor') and the City of Pleasanton ("Grantee"). For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee permanent easements and right of way for roadway, sidewalk and landscaping purposes, including the right to construct, replace, inspect, maintain, repair, operate or remove a roadway, supporting columns, walls and footings, sidewalks, pathways, landscaping including any and all appurtenances thereto, over, under, upon and across the following described real property situated in the City of Pleasanton, County of Alameda, State of California, described as follows: Exhibits 'A" "B," "C," and "D" attached hereto and made a part hereof. The Grantor reserves the right to use the easement parcels for all purposes not inconsistent with the easements. However, such use by the Grantor shall not include the construction of permanent structures, including but not limited to buildings, retaining walls, decks, patios, or other concrete structures within the easements. Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the surface of the ground to the condition in which it was prior to the commencement of said construction. This instrument shall run with the land and inure to the benefit of the successors and assigns of the parties hereto.
