2. Property subject to agreement. The property which is the <br />subject of this Agreement is described in Exhibit "A". <br /> <br /> 3. ~andsc.aPing Plan. Reference is made to the <br /> <br /> proceedings of June ]4 , 1979 and the landscaping <br /> <br />plan which, by Condition ]] of the Design Revtew BQard __approval <br />is to be (has been) approved by the Planning Department. Copies of <br />said landscaping plan will be (is) kept on file with the City in the <br />office of the Planning Director, Civic Center, 200 Bernal Avenue, <br />Pleasanton, California. <br /> <br /> 4. Landscaping as a benefit. Property owner agrees that the <br />landscaping which he is obligated to provide will materially benefit <br />his property and it is necessary to comply with the Design R.v~ <br /> <br /> Board approval conditions imposed by the City as a require- <br /> <br />ment of the development of the property, as shown in ResolutionR-?9-25 <br />incorporated by reference herein and attached hereto as Exhibit "B". <br /> <br /> 5. Duty to maintain landscaping. Property owner agrees to <br />diligently maintain and care for the landscaping which he installs, <br />using generally accepted methods for cultivation and watering. Pro- <br />perty owner shall maintain that standard of care necessary to prevent <br />the landscaping from deteriorating to the extent that its value as <br />landscaping is destroyed. <br /> <br /> 6. City may maintain landscaping. Property owner agrees that <br /> if he fails to meet the standard of maintenance necessary to keep the <br /> landscaping in a healthy condition, the City may elect to take the <br /> steps necessary to assure that the landscaping is maintained and <br /> cared for. To do this, the City shall serve a notice of its intent <br /> <br />-2- <br /> <br /> <br />
