DocuSign Envelope ID 59606AE3-0C6E-4722-9805-B4OECC62BED1 <br /> LICENSE AND CONNECTOR PIPE SCREEN MAINTENANCE AGREEMENT <br /> Portion of 6920 Koll Center Parkway <br /> THIS LICENSE AND CONNECTOR PIPE SCREEN MAINTENANCE <br /> AGREEMENT (the "Agreement") is entered into fr�� � , 2021, by and between <br /> the City of Pleasanton, a municipal corporation ("City") and Common Area TR 9755 <br /> ("Owner"), the owner of real property described in this Agreement. <br /> RECITALS <br /> WHEREAS, to prevent trash from entering the storm drain system in support of <br /> the City's National Pollutant Discharge Elimination System (NPDES) permit, the City <br /> seeks to install and maintain: (i) a trash capture device within the City's utility easement; <br /> and (ii) a connector pipe screen located within a private storm drain manhole (both the <br /> trash capture device and connector pipe screen are collectively referred to as "trash <br /> capture devices") on a portion of the Owner's real property commonly known as 6900 <br /> Koll Center Parkway, City of Pleasanton, State of California (the "Property", also known <br /> as APN 946-4616-5); and <br /> WHEREAS, Owner is willing to allow City to enter onto a portion of Owner's <br /> Property to install the trash capture devices, and to enter onto the Property to maintain <br /> both the trash capture device and the connector pipe screen, subject to the terms of this <br /> Agreement. <br /> NOW, THEREFORE, in consideration of the mutual promises contained in this <br /> Agreement, the parties agree as follows: <br /> 1. Purpose. The purpose of this Agreement is to: <br /> a. allow the City to enter a portion of the Property and install the trash capture <br /> devices in the Installation Area shown in Exhibit A; and <br /> b. provide a license to the City to enter portions of the Property for continued <br /> maintenance by the City of the trash capture devices, generally described in <br /> Exhibit A. <br /> 2. Temporary Construction License. Owner gives to City, its employees, and <br /> contractors a non-exclusive temporary construction license over, upon and across the <br /> area shown in Exhibit A's sheet C-7 (the "Temporary Construction License"). <br /> City's use of the Temporary Construction License shall be for the purpose of City, <br /> its employees and contractors installing the trash capture devices in the Installation <br /> Area at City's sole cost and expense. City shall not commence installation work until the <br /> dates and times of such installation work are coordinated in advance by the City's <br />
