6. CONSTRUCTION, INSTALLATION AND MODIFICATIONS <br /> 6.1. Request for Authorization <br /> Prior to submitting any application for City-issued Regulatory Approvals, Licensee shall <br /> submit a request for authorization ("RFA") to license Vertical Infrastructure in the form <br /> more particularly described and depicted in Exhibit A-2 (Request for Authorization). The <br /> RFA shall (a) identify the Vertical Infrastructure subject to the request; (b) contain <br /> preliminary plans and equipment specifications, which include without limitation all <br /> equipment, mounts, hardware, utilities, cables, conduits, signage, concealment elements <br /> and other improvements proposed by Licensee (collectively, the "Preliminary Plans"); <br /> and (c) provide Licensee's express assent to all the terms and conditions of this License. <br /> Licensee's RFA shall be subject to the City's approval and will be deemed rejected if the <br /> City does not approve or reject such request within 10 days after receipt. The City shall <br /> provide its approval by countersigning the RFA, which may be submitted to applicable <br /> City departments or other public agencies in connection with applications for Regulatory <br /> Approvals. <br /> 6.2. Regulatory Approvals <br /> Licensee shall not commence any installation, construction and other work on or about <br /> the License Area until and unless Licensee first obtains all necessary prior Regulatory <br /> Approvals, which includes without limitation any approvals required to provide the <br /> services offered by Licensee either to the public or Licensee's customers within the <br /> geographic area that encompasses the City's territorial and/or jurisdictional boundaries, <br /> and any required use permits, design review permits, encroachment permits, building <br /> permits, grading permits and electrical permits. Any installation, construction or other <br /> work performed by Licensee or its Agents or Invitees without such Regulatory Approvals <br /> will be a default under this License in addition to any other liabilities or penalties the City, <br /> in its regulatory capacity, may impose on Licensee for the same acts or omissions. <br /> 6.3. Compliance with Approved Plans <br /> Licensee shall perform all installation, construction and other work in connection with the <br /> License Area (a) in accordance with the terms and conditions in this License; (b) at <br /> Licensee's sole cost and expense, and at no cost to the City; (3) in strict compliance with <br /> the Approved Plans; (4) in compliance with all applicable Laws, which includes without <br /> limitation all applicable provisions in the Pleasanton Municipal Code and any conditions <br /> in any applicable Regulatory Approvals; (5) in a safe, diligent, skillful and workmanlike <br /> manner; and (6) to the satisfaction of the Community Development Director or his/her <br /> designee.
