('

Mr. McDonald noted that they tried to think outside the box regarding the green building
requirements. He noted that some of the control would be lost when custom homes were
built, and asked which homes would slotted for photovoltaics.

Chairperson Maas replied that the lots with the least visual impact and the proper
exposure to the sun would be identified.

Chairperson Maas noted that Mr. Iserson and Mr. McDonald would work out the details
regarding the appropriate lots for the photovoltaics.

In response to an inquiry by Commissioner Sullivan, Mr. Iserson confirmed that at the
time ofrecording the Final Map, the lots with the PV panels would be designated based
on their orientation and preliminary designated house layout.

Commissioner Sullivan noted that the photovoltaic conditions would be included in the
purchase disclosure.

THE PUBLIC HEARING WAS CLOSED.

In response to an inquiry by Commissioner Kameny, Mr. Iserson noted that the
modification on page 16 would be processed as a minor modification.

,...-

Chairperson Maas suggested examining the five modifications on page 3 of the staff
report.

Commissioner Kameny did not object to Item I.

Commissioner Sullivan had concerns regarding Items I and 3. He did not agree with
staff s conclusion that houses were not very visible, and added that they had discussed
this issue before. He believed these houses would be very visible, especially from 580
and BART.

Chairperson Maas believed that the size of the homes should be kept as approved, and
that the size should not be increased.

Commissioner Sullivan believed the homes were already too visible from the ridge line.

Commissioner Kameny did not believe that seeing a house from 580 was much of a
problem.

Chairperson Maas noted that the Commission had spent so much time on that area, which
was very sensitive.

Commissioner Kameny noted that landscaping would mitigate the visual impact when it
was installed.

,--.

Plarming Commission Minutes

August 28, 2002

Page 18
