trust. Mr. Nilson drew the attention of the Council to Mr. Richard appearing at
the meeting on December 2nd at which time he did not inform in any way that there
was anyone concerned in the property other than himself. The Council understood
at that time that Mr. Richards was the owner and accordingly at this the Lucas
matter should not interfer. The Clerk then brought to the attention of the Council
its willingness to co- operate with Mr. Richards by giving him as much of the work
down there as possible, that gravel had been purchased from him for the curb and
gutter work and that his truck and man had been hired to clean out the fill,
and such other work that would show the Council to be well disposed towards
Mr. Richards. Mayor Orloff advised that the Council had been willing all along
to treat Mr. Richards kindly and that he should in turn co- operate with the Council
to the end that the slopewall work should be completed without delay.
Mr. Ri chardswas questioned with regards to what he was expecting as regards
the fill at the slope wall as he had inferred that in case the Council saw fit to
buy the back fill from someone else that he would not be willing to sign the deed.
./ Mr. Richards advised that it was his intention to use the money ,derived from the
back fill in squaring up his account with h1r.Lucas as he had been promised by
the First National Bank that it would carry a loan on the property assist him
with his operations. Mr. Nilson riformdd?,s. Richards to sign the deed and
as money was available from work done that it Could be used to pay off Mr.
Lucas. The discussion closed with Mr. Richards expressing himself as being
willing to.see Mr. Harding on the following day.
The Clerk then presented Claims No. 418, 419 and 420, presented by Mr. Richards
and concerning truck hire, equipment hire and mans wages for work done at the
slopewall and amounting to $0153.31. On motion of Councilman Rivolta, seconded
by Councilman Madsen and with all the Councilmen in favor of same these claims
