23. Sewerage Capacity. The developer acknowledges that the City <br /> of Pleasanton does not guarantee the availability of <br /> sufficient sewerage capacity to serve this development by <br /> approval of this project and that the developer agrees and <br /> acknowledges that building permits may be withheld if <br /> sewerage capacity is found by the City not to be available. <br /> <br />24. Bicycle Storage. Each development within the project shall <br /> provide bicycle storage facilities adequate to meet <br /> anticipated demand. <br /> <br />25. Noise Levels. All commercial and office structures on the <br /> subject property shall be designed so that interior noise <br /> levels shall not be higher than 55 dBA Leq during business <br /> hours. In the event a hotel is built in the project, the <br /> hotel shall be designed so that the interior noise level <br /> shall not be higher than 45 dBA Ldn. <br /> <br />26. Newspaper Dispensers. Only modular newspaper dispensers <br /> accommodating more than one newspaper shall be allowed <br /> outside of buildings within the development; the design of <br /> these dispensers shall be approved by the Planning Division. <br /> <br />27. Seismic Safety. Building designs shall comply with <br /> then-current seismic requirements of the City. Pile <br /> foundations shall be used for mid-rise buildings unless a <br /> compensating design satisfactory to the City is found to be <br /> feasible. The minimum setback from the top of a stream <br /> channel edge shall be 100 feet. <br /> <br />28. Parks and Recreation. The Developer shall participate in <br />the provision of parks and recreation facilities in a manner <br />to be determined by the City following a study of the <br />reasonable parks and recreation needs of employees of the <br />north Pleasanton business parks. The project's participation <br />shall be equal to its pro rata share of the capital cost of <br />acquiring and developing the park and recreation facilities <br />determined to be necessary. The manner of the project's <br />participation, whether through development fees, assessment <br />districts, or some other manner, shall be determined upon <br />City review of the aforementioned study and shall take into <br />consideration park and recreation needs at present and in the <br />future by phasing necessary improvements as appropriate. The <br />project developer shall cooperate with the City in providing <br />said park and recreation facilities by making this obligation <br />run with the land within the project and by cooperating in <br />its personal capacity as an owner of property elsewhere in <br />north Pleasanton. The City agrees to use its best efforts to <br /> assess all north Pleasanton business park <br /> developers/employers on a pro rata basis for the park and <br /> recreation facilities made necessary by the north Pleasanton <br /> development, and the City shall explore methods to accomplish <br /> this as part of the aforementioned study. <br /> <br />Conditions of Approval PUD-85-8 <br />February 1986 <br /> <br /> <br />
