COUNTY OF ALAMEDA <br /> REAL PROPERTY LICENSE AGREEMENT <br /> THIS LICENSE AGREEMENT made and entered into this 1st day of <br /> July 1991, by and between the County of Alameda, a political subdivision of <br /> the State of California, hereinafter referred to as "COUNTY and Specialty <br /> Sales, hereinafter referred to as "LICENSEE <br /> W I T N E S S E T H: <br /> WHEREAS, the County has a County Highway that it refers to as its <br /> "Niles Canyon Transportation Corridor" County Road No. 8111, (Downtown <br /> Pleasanton Segment) which is necessary for use as a transportation corridor in <br /> both the unincorporated area of the County of Alameda, Pleasanton Township and <br /> in the City of Pleasanton. Said property and highway thereon was acquired by a <br /> deed from the Southern Pacific Transportation Company recorded February 28, <br /> 1989, as Series No. 89- 055743 of the Alameda County Recorder's office; and <br /> WHEREAS, the COUNTY is willing to allow its highway property to be <br /> occupied, so far as possible, by compatible uses if said uses do not interfere <br /> with COUNTY's use of the property for highway purposes and until the COUNTY <br /> desires to retake possession of the highway fur its exc1usi•.a .se, and <br /> WHEREAS, it is not presently necessary for COUNTY to use exclusively <br /> that certain portion of highway generally known and described as the Niles <br /> Canyon Transportation Corridor (Downtown Pleasanton Segment), more particularly <br /> shown highlighted in red on Exhibit "A" attached hereto and made a part hereof. <br /> NOW, THEREFORE, BE IT AGREED, that for and in consideration of the <br /> mutual covenants herein set forth and the mutual benefits to be derived by the <br /> parties hereto, COUNTY hereby confers to LICENSEE the license and privilege to <br /> use, subject to COUNTY's superior right of possession, for vehicular access from <br /> the rear of Licensee's building to and from Spring Street only, that certain <br /> Y U:LlvIi of highway UGJ'.1 IL.:U ul.v VC. <br /> -1- <br />
