15. Letter from Al LaVerne Spotorno <br /> 15.1 The Tri-Valley Business Council's Working Landscape Plan is briefly described on p.14 -14 <br /> and 14 -15 of the Draft Subregional Planning Element. Although the Vision 2010 work is <br /> not discussed extensively, the General Plan incorporates Goals, Policies, and Programs to <br /> encourage the continuation of agricultural uses in several areas, including a goal, policies and <br /> programs addressing agriculture and grazing starting on p. 7 -39 of the Draft Open Space and <br /> Conservation Element, and Policy 12 and associated programs (p.14 -23) of the Draft <br /> Subregional Planning Element. <br /> 15.2 The reference in the comment to "the open space issue" is not clear. Policy 19 of the Land <br /> Use Element does address open space and provides that designated open -space areas are to <br /> be preserved for the protection of public health and safety, to provide recreational <br /> opportunities, agriculture and grazing, for natural resources, to preserve wildlands, to <br /> manage water, and to separate Pleasanton physically from its neighboring communities. <br /> Program 19.1 then provides ways to implement that Policy, including the dedication of open <br /> space when property develops. Such dedication, however, is not specifically to maintain <br /> wildlife, although that may be a consequence in some instances. Predators are found where <br /> there is livestock and it seems unlikely there is anything the City can reasonably do to resolve <br /> what the commenter perceives as a conflict. <br /> 15.3 The City adopted a Right to Farm Ordinance in 1994 [Chapter 17.48, Pleasanton Municipal Code], <br /> which Ordinance is largely self implementing. Its purpose is to encourage continued <br /> agricultural operations and to provide a means to resolve conflicts between agricultural and <br /> nonagricultural property owners concerning agricultural operations. In part the Ordinance <br /> provides that no agricultural operation conducted consistent with accepted customs and <br /> standards of the agricultural industry shall be considered a nuisance. To the City staff's <br /> knowledge, the commenter has never employed the dispute resolution procedures set forth <br /> in the Ordinance. <br /> 15.4 The South Livermore Valley Area Plan includes a policy to: "Encourage the development of <br /> additional sources of irrigation water for vineyards and other cultivated agriculture by <br /> investigating wastewater reclamation and development of other supply and delivery sources. <br /> Encourage Zone 7 to consider developing a pump monitoring and cost allocation system to <br /> cover the cost of new water in the event that additional supplies are needed." The South <br /> Livermore Valley Area Plan does encourages the development and /or distribution of <br /> untreated (irrigation water) to the South Livermore area. However, the untreated water <br /> customers have contracts directly with the Zone 7 Water Agency and the City of Livermore <br /> is not involved directly with water supplies to viticulture and other agricultural products in <br /> the area. Although the City of Pleasanton does not have a contract for untreated water from <br /> Zone 7, agricultural users in Pleasanton outside of this plan area have some other options. If <br /> the City Council determines that the capacity exists, land within the Urban Growth <br /> Boundary can be served from the City's existing domestic water supplies, the majority of <br /> which are also supplied by the Zone 7 Water Agency, but from its treated water system. <br /> Lands within the City's Urban Growth Boundary are also able to contract directly with Zone <br /> 7 for an untreated water supply and /or negotiate to tie into other existing private untreated <br /> pipelines served by Zone 7 from the South Bay Aqueduct or State Water Project supplies. <br /> The financial feasibility of the latter options depends on the distance between the property <br /> final response to comments with throw pages 59 <br />
