THE CITY OF 2 <br /> �°1 °='r CITY COUNCIL AGENDA REPORT <br /> pL EASANTON <br /> June 2, 2009 <br /> Police Department <br /> Office of the City Attorney <br /> TITLE: PROPOSED INCREASED PARKING CITATION PENALTIES TO <br /> RECOVER INCREASED PENALTIES ASSESSED BY THE STATE AND <br /> TO RECOVER ADMINISTRATIVE COSTS <br /> SUMMARY <br /> In 2008, the State Legislature enacted Senate Bill 1407 to provide, in part, for enhanced <br /> revenues to finance new construction and renovation projects of court facilities <br /> throughout California by increasing the penalties collected for each parking citation. <br /> Prior to SB 1407, Pleasanton was remitting to Alameda County $5.00 per parking <br /> citation (collected) to finance state courthouse and criminal justice facility (i.e., jail) <br /> construction. SB 1407 increased the amount to $9.50. <br /> Parking citation penalties have not been increased in Pleasanton since they were <br /> originally adopted in 1993. To recover the additional penalties imposed by SB 1407 as <br /> well as the increase in the City's enforcement and parking citation processing <br /> administrative costs since the penalties were adopted in 1993, staff recommends <br /> amending the Master Fee Schedule to increase all parking penalties at least $25. Staff <br /> also recommends increasing penalties above $25 for some parking violations, such as <br /> parking along curbs that are painted red, parking over 72 hours, and parking without a <br /> placard in spaces designated for persons with disabilities. Staff also recommends <br /> charging for cancelled citations upon proof of a vehicle's registration, equipment <br /> violation correction, or disabled placard. Staff further recommends adding to the Master <br /> Fee Schedule additional parking violations that are not currently included and amending <br /> the Municipal Code to consolidate parking penalties in the General Penalty Chapter <br /> (PMC Chapter 1.12). <br /> RECOMMENDATION <br /> Adopt the attached resolution that amends the Master Fee Schedule, effective July 1, <br /> 2009, to increase currently enumerated parking penalties and include additional parking <br /> penalties and fees. <br /> Introduce the attached ordinance to revise Municipal Code Chapter 1.12 (General <br /> Penalty) and Chapter 11.38 (Parking Permit) to consolidate parking penalties in Chapter <br /> 1.12. <br />
