THE CITY OF
m LIPS 1
pL€ ASANTON.
GEOLOGIC HAZARD ABATEMENT DISTRICT
AGENDA REPORT
May 19, 2009
Community Development
Engineering Division
TITLE: ANNUAL ASSESSMENTS FOR THE GEOLOGIC HAZARD ABATEMENT
DISTRICTS (GHAD'S) FOR OAK TREE FARM, MOLLER RANCH, LAUREL
CREEK ESTATES (THE PRESERVE, OAK HILL ESTATES, AND KOLB
RANCH ESTATES), AND LEMOINE RANCH ESTATES
SUMMARY
A Geologic Hazard Abatement District (GHAD) is a property assessment district that is
used to pay for any landslide repairs and related geologic and storm drainage
monitoring, maintenance and repair work within the District. The City has formed four
GHADs: Oak Tree Farm, Moller Ranch, Laurel Creek Estates (The Preserve, Oak Hill
Estates and Kolb Ranch Estates) and Lemoine Ranch Estates. All are located on the
west side of Foothill Road and are in areas that require annual monitoring and
maintenance of geologic features. This report establishes the proposed annual
assessments to be levied on properties within the Districts for the upcoming tax year.
RECOMMENDATION
1. Convene as the Board of Directors for the Oak Tree Farm, Moller Ranch, Laurel
Creek Estates (The Preserve, Oak Hill Estates and Kolb Ranch Estates) and
Lemoine Ranch Estates Geologic Hazard Abatement Districts.
2. Adopt a resolution approving the Engineer's Reports for the subject GHADs and
approving and declaring the Board's intentions to assess the properties within the
GHADs for the costs to maintain and operate the GHADs.
3. Set June 16, 2009, as the date of the public hearings for the Board to hear protests
concerning the proposed assessments.
4. Direct the Clerk of the District to mail a notice of the public hearings to the owners of
real property located in the Geologic Hazard Abatement Districts.
5. Appoint the City Engineer as the General Manager of the Geologic Hazard
Abatement Districts.
FINANCIAL STATEMENT
Funding of these GHADs will have a minimal financial effect on the City. As required by
Proposition 218, the City pays a share of the assessments as the owner of parcels of
land within each of these Districts upon which public facilities (such as water tanks and
pump stations) are located. The assessments are as follows: Oak Tree Farm ($275);
Moller Ranch ($104); and Laurel Creek Estates ($724). Staff's cost to administer these
Districts will continue to be funded by the assessments.
2
