12 <br />THE CITY OF <br />~# "' "' -'- "" CITY COUNCIL AGENDA REPORT <br />j~L£~S~4NTONo <br />April 21, 2009 <br />Community Development <br />Planning Division <br />TITLE: PUD-77, CLANCY DUTRA, DUTRA TRUST LLC -CONSIDER AN <br />APPLICATION FOR PLANNED UNIT DEVELOPMENT (PUD) <br />DEVELOPMENT PLAN TO SUBDIVIDE A TEN-ACRE SITE AT <br />1053 HAPPY VALLEY ROAD INTO FIVE SINGLE-FAMILY <br />RESIDENTIAL LOTS AND ONE OPEN SPACE PARCEL <br />SUMMARY <br />The applicant proposes a development plan for an approximately 10.2-acre site to <br />establish six lots -five custom home lots and one open space parcel owned and <br />maintained by a homeowners association. A private road, including a bridge across a <br />seasonal drainage way, would provide access to both the proposed home sites and an <br />existing home on the adjacent site. A Negative Declaration has been prepared which <br />found that the proposed development would have minimal environmental impacts. <br />PLANNING COMMISSION RECOMMENDATION <br />On January 14, 2009, the Planning Commission recommended approval of the PUD <br />development plan application, subject to the attached conditions shown in Exhibit B of <br />Attachment 1. <br />RECOMMENDATION <br />1. Find that the project would not have a significant effect on the environment, and <br />adopt a resolution approving the draft Negative Declaration; <br />2. Find that the proposed PUD development plan is consistent with the General Plan <br />and the purposes of the PUD ordinance; <br />3. Make the PUD findings for the proposed development plan as stated in the <br />January 14, 2009, Planning Commission staff report (Attachment 5); and <br />4. Introduce the attached draft ordinance approving Case PUD-77, PUD development <br />plan approval for five single-family custom home lots and one open space lot, <br />subject to the Conditions of Approval, Exhibit B of Attachment 1. <br />FINANCIAL STATEMENT <br />The project would be expected to generate development impact fees and property tax <br />revenues. The private road, bridge, storm water system, open space area, street <br />landscaping, etc. would be owned and maintained by a homeowners association and <br />will not be the responsibility of the City. <br />
