THE CITY OF <br />~f~°° ° ~=' ~ ~ "" CITY COUNCIL AGENDA REPORT <br />~L~~S~4NTONa <br />March 3, 2009 <br />Community Development <br />Engineering Division <br />TITLE: ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR TRACT 7255, <br />AUGUSTIN KNOLLS (GREENBRIAR HOMES) AND ACCEPTANCE OF <br />FUNDS IN LIEU OF CERTAIN ROADWAY IMPROVEMENTS <br />SUMMARY <br />Greenbriar Homes has developed residential properties on the west side of I-680, Tract <br />7255, Augustin Knolls, consisting of 232 single-family residential units (see Attachment <br />1). This development is now complete and Greenbriar Homes is requesting acceptance <br />of the public improvements within this development. In addition, BIC was required to <br />construct certain roadway improvements between the second Bernal Bridge across the <br />Arroyo de la Laguna (which has not yet been constructed) and the on ramp to I-680 <br />south. Because of the uncertainty as to when the second bridge will be built, BIC has <br />offered the City $915,000 in lieu of its constructing those improvements in the future. <br />The improvements primarily relate to resurfacing a short stretch of Bernal and restriping <br />the street to accommodate the second bridge. The obligation to build the bridge <br />remains a City obligation in partnership with DeSilva Gates. <br />Staff recommends that this offer be accepted. <br />RECOMMENDATION <br />1. Accept for normal maintenance the list of public improvements stated below for on- <br />and off-site improvements for Tract 7255, Augustin Knolls. <br />2. Authorize the City Clerk to file a Notice of Completion. <br />3. Authorize the City Manager to accept Parcel J of Tract 7255 in fee title by separate <br />instrument. <br />4. Accept $915,000 from BIC in lieu of BIC's constructing the remaining Bernal Avenue <br />improvements and release the bonds for these improvements upon receipt of these <br />funds. <br />FINANCIAL STATEMENT <br />There are annual costs associated with routine maintenance when public improvements <br />are accepted. The additional maintenance cost for the public facilities is estimated to be <br />approximately $30,000 annually. When the second Bernal Bridge is constructed, the <br />$915,000 will be available for the City to have the remaining Bernal Avenue <br />improvements constructed. <br />
