~. <br />~~j:'U'~~'l <br />~~r> ~ JOINT POWERS AGREEMENT <br />REGARDING AMADOR THEATER <br />THIS AGREEMENT is made and entered into this 3rd day of <br />June 1986, by and between the CITY OF PLEASANTON, a <br />municipal corporation and general law city (hereinafter called <br />"City") and the AMADOR VALLEY JOINT UNION HIGH SCHOOL DISTRICT, a <br />school district formed and existing under and by virtue of the <br />Education Code of the State of California (hereinafter called <br />"District"). <br />R E C I T A L S <br />A. Joint Powers Authority. <br />Pursuant to California Government Code Section 6502, the <br />City of Pleasanton and the Amador Valley Joint Union High School <br />District may, by agreement, jointly exercise any power common to <br />them. <br />B. Community Center Authority. <br />Pursuant to California Education Code Sections 10902 and <br />10905, said public authorities may enter into agreements for the <br />mutual promotion and conduct of community recreation programs, <br />and to maintain and operate community recreation and civic <br />centers. <br />C. Benefit to Community. <br />Both parties desire to establish the Amador Theater <br />(hereinafter called "Theater"), located on the campus of the <br />Amador Valley High School, as a community civic center and to <br />provide for its ongoing management. In accordance with the terms <br />set forth below, this Agreement will provide for the management <br />and operation of the Theater when renovation is completed. In <br />this manner, the people of Pleasanton will be provided a <br />performing arts center for drama, ballet, symphony, choral, and <br />other cultural activities. This agreement will promote the <br />purposes set forth in state statutes in the following ways: <br />One. A rejuvenated Amador Theater will present the people of <br />Pleasanton, including students, with a greater variety of <br />cultural events than are now available in Pleasanton. <br />Two. The people of Pleasanton, including students, will have <br />greater opportunity to participate in the performing arts. <br />Three. The joint use provided by this Agreement will <br />maximize the efficient use of the resources available to the City <br />and the District. <br />- 1 - <br />
