2
THE CITY OF
L£~S~4NTONo CITY COUNCIL AGENDA REPORT
July 15, 2008
Law Department
TITLE: CERTIFICATION OF TAXES AND ASSESSMENTS CONCERNING
PROPOSITON 218
SUMMARY
Every year cities throughout Alameda County request the County to place on upcoming
property tax bills certain taxes and/or assessments levied by the cities. The County
requires the cities to certify that these taxes and assessments comply with Proposition
218 before placing the items on the tax bill. The County also wants to be indemnified to
the extent there is a legal challenge to any of the taxes or assessments. The attached
resolution makes the necessary certification and authorizes the City Attorney to sign the
attached Certification and Mutual Indemnification.
RECOMMENDATION
Adopt the attached resolution certifying that the taxes and assessments that the City will
request the County to place on the 2008/2009 tax rolls meet the requirements of
Proposition 218 and authorizing the City Attorney to sign the Certification and
Indemnification Agreement.
FINANCIAL STATEMENT
If one of the assessments were challenged, the City would incur legal costs to defend the
challenge; we would also be responsible for any judgment imposed on the County as a
result of the City's failure to comply with Proposition 218.
