PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 1855 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON APPROVING A TENTATIVE MAP FOR <br />TRACT 4539, CENTEX HOMES. <br />WHEREAS, Centex Homes has applied for tentative map approval for <br />a 79-lot residential subdivision to be located on a <br />32.4 acre site between Pleasanton School upper playfield <br />and Mirador Drive immediately southerly of the residences <br />bordering Angela Street; and <br />WHEREAS, the site is zoned PUD-Residential (Planned Unit Development- <br />Residential) District; and <br />WHEREAS, the Planning Commission took public testimony concerning <br />this application. <br />NOW, TFIEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. The Planning Commission approves this application <br />subject to the conditions shown because all of the <br />'- required findings could be made: <br />1. That the development be substantially as shown on <br />Tentative Map Tract 4539 except that the pedestrian <br />access road to Pleasanton School be moved to the <br />northern cul-de-sac and except as modified in final <br />engineering design. <br />2. That the subdivider acknowledge that the City of <br />Pleasanton does not guarantee the availability of <br />sufficient sewer capacity to serve this development <br />by approval of this tentative tract map and that the <br />subdivider agrees and acknowledges that either the <br />final map or building permit approval may be withheld <br />if sewer capacity is found by the City not to be <br />available. <br />3. That upon approval of this tentative map, the <br />subdivider shall enter into a contract approved <br />by the City Attorney regarding the availability <br />of sewer capacity and acknowledges that no promises <br />of capacity are made by the City as part of this <br />approval. <br />
