PLANNING COMMISSION <br />City of Pleasanton <br />RESOLUTION NO. 1399 <br />A RESOLUTION FINDING CONFORMITY WITH <br />GENERAL PLAN OF PROPOSED QUITCLAIM <br />OF PROPERTY TO DUKE BONDE. <br />WHEREAS, in 1955, a 1.0 acre site was acquired from Mr. Duke <br />Bonde easterly of the upper end of Abbie Street for the siting <br />of a water reservoir to serve the Pleasanton Heights area. As <br />development occurred in the Vintage Hills area, the water <br />reservoir previously constructed became inadequate to serve the <br />area and a new, larger reservoir had to be constructed. At that <br />time, Mr. Bonde did not desire to sell any more of his property <br />but agreed to a new configuration for the one acre previously <br />lacquired that would accommodate the location of the new reservoir. <br />This new site partially overlapped the old site and the new <br />site was deeded to the City with the understanding that the <br />remainder of the old site would be quitclaimed to Mr. Bonde. To <br />comply with this understanding, it is now necessary to quitclaim <br />this remainder to Mr. Bonde; and <br />WHEREAS, Government Code Section 95402(a) requires that <br />"If a General Plan or part thereof has been adopted, ... no real <br />property shall be disposed of ... until the location, purpose <br />and extent of such ... disposition ... have been submitted to <br />and reported upon by the planning agency as to conformity with <br />said adopted general plan. ... "; and <br />WHEREAS, the Bonde reservoir site is shown on the General <br />Plan as open space, but it is the City's intent to allow public <br />utilities of this type in the open space district once the open <br />space ordinance is developed. <br />
